1. About these terms

  • soirly.com is operated by 1448718 B.C. Ltd., doing business as Soirly ("Soirly", "we", "us"). These terms apply when you visit our site or buy from us.
  • By placing an order, you agree to these terms, our Refund Policy, our Shipping Policy and our Privacy Policy.

2. Eligibility

You must be at least the age of majority in your province or territory to place an order.

3. Our products

  • Soirly products are cosmetics for external use only.
  • They aren't intended to diagnose, treat, cure or prevent any disease or health condition.
  • Read the full ingredient list before use.
  • Patch-test on a small area of skin first.
  • Stop using the product if irritation occurs.
  • If you're pregnant, nursing, or have a skin condition, ask a healthcare professional before use.

4. Prices and availability

  • Prices are in Canadian dollars and don't include taxes or shipping unless stated.
  • We may change prices, products or offers at any time. Changes don't affect orders we've already confirmed.
  • We try to describe products and prices accurately. If we find an error in the price of an order, we'll contact you and let you choose to confirm the order at the correct price or cancel it for a full refund.

5. Orders

  • An order is accepted when we send a shipping confirmation.
  • We may limit or cancel orders that appear fraudulent, are placed for resale, or exceed reasonable quantities. If we cancel a paid order, we'll refund you in full.

6. Payment and taxes

  • Payment is taken when you place your order, through Shopify's secure checkout.
  • Applicable sales taxes are added at checkout.

7. Subscriptions

If you choose a subscription:

  • You authorize us to charge your payment method for each delivery at the price and interval shown at checkout, until you cancel.
  • Before any price change, we'll email you at least 30 days in advance.
  • You can skip, pause or cancel at any time before your next renewal date from your account, or by emailing team@soirly.com.
  • Cancelling stops future charges. It doesn't refund orders that have already been processed. Those follow our Refund Policy.

8. Shipping and returns

Shipping and returns are covered by our Shipping Policy and Refund Policy, which form part of these terms.

9. Reviews and content you submit

  • When you submit a review, photo or other content, you give us a non-exclusive, royalty-free right to display and share it in connection with Soirly.
  • We moderate reviews before they're published.
  • We may decline or remove content that is offensive or off-topic, contains personal information, or describes health or medical outcomes, since our products are cosmetics.
  • We never edit the meaning of a review.

10. Intellectual property

The Soirly name, logo, text, photos and designs on this site belong to us or our licensors. You may not copy or use them without our written permission.

11. Third-party links and services

Our site may link to third-party sites or use third-party services, such as payment processors and carriers. We aren't responsible for their content or practices.

12. Disclaimer

To the extent permitted by law, our site and products are provided "as is". We make no warranties beyond those stated in these terms or required by law.

13. Limitation of liability

To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We aren't liable for indirect or consequential losses.

14. Your consumer rights

Nothing in these terms limits rights you have under consumer protection laws that can't be waived. This includes, for residents of Quebec, the Consumer Protection Act. Some of the limits above may not apply to you.

15. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, subject to Section 14.

16. Changes

We may update these terms from time to time. The version posted when you place an order applies to that order.
